Education Required

The state of Indiana under IC25-22-5-1-1.1 defines the use of lasers as the practice of medicine. See the statute below:

(a) “practice of medicine or osteopathic medicine” means any one (1) or a combination of the following:
(1) Holding oneself out to the public as being engaged in:
(C) the performing of any kind of surgical operation upon a human being, including tattooing, except for tattooing (as defined in IC 35-42-2-7), in which human tissue is cut, burned or vaporized by the use of any mechanical means, laser, or ionizing radiation, or the penetration of the skin or body orifice by any means, for the intended palliation, relief or cure;”

As such, only licensed physicians may perform laser treatments or delegate them to “an agent”. The term “Agent” is not defined in any statute or ruling in Indiana.

Section 1.20 of the above statute does reference the right of a physician to delegate treatments to employees so long as it falls within the scope of the physician’s practice:

“(20) An employee of a physician or group of physicians who performs an act, a duty, or a function that is customarily within the specific area of practice of the employing physician or group of physicians, if the act, duty, or function is performed under the direction and supervision of the employing physician or a physician of the employing group within whose area of practice the act, duty, or function falls.”

Since the supervising physician will hold responsibility for the actions of any laser technician employed by them, the physician will likely require specific training in the use of laser treatments and safety protocols.

Indiana Laser Technician Certification(s)

The Indiana Medical Board does not require licensure by laser technicians performing treatments within the state, so long as they are an employee of a licensed physician who’s practice involves laser treatment. While no license is required, physicians may set their own requirements for education and outside licensure by other organizations.
